Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cryptss Pay platform, website, and services ("Services"), operated by Cryptss ("we", "us", "our"). By creating an account or using our Services, you agree to be bound by these Terms.
1. Eligibility
To use our Services, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into binding contracts.
- Not be located in, or a citizen or resident of, any country subject to comprehensive sanctions (including but not limited to North Korea, Iran, Syria, Cuba, and the Crimea region).
- Not be listed on any sanctions list (OFAC SDN, EU, UN, or equivalent).
- Complete identity verification (KYC/KYB) before accessing cash-out or certain other features.
2. Account Registration
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the security of your account credentials, including passkeys and passwords.
- You must notify us immediately of any unauthorized access to your account.
- One individual may maintain only one personal account. Businesses may register separate business accounts.
- We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
3. Description of Services
Cryptss Pay provides:
- Stablecoin invoicing (USDC, USDT) on supported blockchains (Base, Polygon, Solana).
- Escrow services for holding funds until work is approved.
- Cash-out to local bank accounts via licensed payment partners.
- A Visa card for spending stablecoin balances.
- An AI copilot for invoice drafting and payment management.
- An x402 agent payment rail for machine-to-machine transactions.
- API access for developers (Business plan).
4. Fees
- Starter plan: Free. 0% platform fee on your first 5 invoices.
- Pro plan: $9/month. Standard platform fees apply after the first 5 invoices.
- Business plan: $49/month. Includes API access, team seats, and priority support.
- FX fee: Approximately 0.4% on cash-out conversions. Exact rate displayed before confirmation.
- Card fees: Interchange fees apply to card transactions. Details shown in your card settings.
All fees are displayed clearly before each transaction. We reserve the right to change fees with 30 days' notice.
5. Payments and Settlement
- Stablecoin payments settle on-chain. Settlement time depends on blockchain confirmation times.
- Cash-out times depend on the destination bank and corridor. Most payouts settle within minutes to a few hours.
- FX rates are quoted at the time of cash-out and are valid for a limited window (displayed before confirmation).
- All transactions are final once confirmed on-chain. Reversals are only possible through our dispute resolution process.
6. Escrow and Disputes
- When escrow is enabled, funds are held until the sender approves release or a dispute is resolved.
- Either party may open a dispute within the escrow period.
- Cryptss mediates disputes in good faith. Our mediation decision is final.
- Partial releases and refunds are supported within the escrow workflow.
7. Identity Verification (KYC/KYB)
- You may create an account, send invoices, and receive stablecoin payments without completing KYC (Tier 0).
- Cash-out to a bank account requires Tier 1 verification (government ID + selfie).
- Higher transaction limits and business features require Tier 2 verification (KYB).
- We use licensed third-party providers for verification. Your documents are stored securely and never on-chain.
- We may request re-verification at any time if we detect changes or suspicious activity.
8. Prohibited Activities
You agree not to use our Services to:
- Violate any applicable law, regulation, or third-party rights.
- Engage in money laundering, terrorist financing, or sanctions evasion.
- Conduct fraudulent transactions or create fake invoices.
- Transmit malware, viruses, or other harmful code.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the Services for gambling, adult content, illegal drugs, weapons, or other prohibited industries.
- Circumvent transaction limits, velocity checks, or other risk controls.
- Misrepresent your identity, business, or the purpose of transactions.
9. Wallets and Custody
- Cryptss provisions an MPC (Multi-Party Computation) wallet for each account automatically.
- You do not receive a seed phrase or private key. Cryptss manages key security on your behalf.
- You are responsible for the accuracy of any external wallet addresses you send funds to.
- Cryptss is not liable for losses resulting from incorrect withdrawal addresses.
10. Card Terms
- The Cryptss Card is issued by our card partner pursuant to a license from Visa.
- Virtual cards are available instantly. Physical cards are shipped within 5 business days.
- Card spending is subject to daily and monthly limits based on your plan and verification tier.
- You are responsible for all transactions made with your card.
- Lost or stolen cards must be reported immediately via the app.
11. AI Copilot and Agent Payments
- The AI copilot provides suggestions and drafts. You are responsible for reviewing and approving all AI-generated content before sending.
- x402 agent payments are subject to the policies you configure. You are responsible for setting appropriate spend limits and approval thresholds.
- Cryptss is not liable for losses resulting from agent payments made within your configured policies.
12. Intellectual Property
- All content, trademarks, and technology on the Cryptss Pay platform are owned by Cryptss or our licensors.
- You retain ownership of your invoices, business data, and content you create using our Services.
- You grant us a limited license to process your data as necessary to provide the Services.
13. Limitation of Liability
To the maximum extent permitted by law:
- Cryptss is not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability is limited to the fees you paid to Cryptss in the 12 months preceding the claim, or $100, whichever is greater.
- We are not liable for losses due to blockchain network failures, smart contract bugs in third-party protocols, or force majeure events.
- We are not liable for losses due to your failure to secure your account credentials.
14. Indemnification
You agree to indemnify and hold harmless Cryptss, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or violation of any law or third-party rights.
15. Termination
- You may close your account at any time. You must withdraw all funds before closure.
- We may suspend or terminate your account for violation of these Terms, suspicious activity, or regulatory requirements.
- Upon termination, you retain the right to withdraw your funds (subject to any holds, disputes, or legal requirements).
- Sections that by their nature should survive termination (fees, liability, disputes, indemnification) remain in effect.
16. Dispute Resolution
- We encourage you to contact us first at support@yellow-scorpion-986337.hostingersite.com to resolve any issues informally.
- If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the International Chamber of Commerce (ICC).
- The arbitration will be conducted in English. The seat of arbitration will be determined based on your jurisdiction.
- Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must close your account before the changes take effect.
18. General
- Entire agreement: These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and Cryptss.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- Waiver: Our failure to enforce any provision does not constitute a waiver.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
